This privacy policy describes how we process personal data when using our mobile application (app) and its functionalities or for bookings via our telephone booking system.

This privacy policy applies exclusively to our mobile iPhone and Android app “Fichtelflexi” (hereinafter referred to as “app”) and to bookings made via our telephone booking system.

The transport service is provided by the transport company Mietauo Licha, Rupprechtstraße 4, 95100 Selb.

What is personal data?

Personal data is any information relating to an identified or identifiable natural person. This may be data that can be related to you personally, for example name, address, e-mail addresses, user behavior.

What data do we collect? How do we use the data we collect from you? What is the legal basis for its use?

a) Installation of the app

When you install this app and create a user account, the following personal data is collected from you

First and last name
e-mail address
Encrypted password
IP address of the last login
Date of the last login
Date of account creation

The data is collected for the purpose of registration and authentication and to verify user identity. The legal basis for this is Art. 6 para. 1a GDPR (consent given by you).

b) Use of the app

When using our app, the following personal data may be collected

Location-related data
You can use our app to request a passenger transportation vehicle for a specific route by entering the following data via the app
Pick-up address,
destination address,
Date and time,
number of passengers.

The purpose of this data collection is to carry out the transportation order and to plan the route of the vehicle. The legal basis for this is Art. 6 para. 1b EU GDPR (performance of contract).

If you would like to use “my location” as your start address and click on the “my current location” button, we can automatically determine your geographical location in real time using your mobile device. The prerequisite for this is that you have activated the location services in our app.

The automatic collection, processing and use of your location-related data will only take place with your consent by giving your location approval. You can withdraw your consent at any time by deactivating the location service. Please note that if you deactivate the location service, you will not be able to use certain functions of our app, as these are an important part of the app.

Data visible to drivers and dispatchers

If you request a vehicle for passenger transportation via the app, the driver (transport company Mietauto Licha) and the dispatcher of the vehicle as well as other relevant employees will be provided with the following data or part of it:

Your first name and surname
the start and destination address
the number of persons whose transportation you require and
the total price of passenger transportation for the specified route.
The purpose of this use of data is the execution of the transportation order. The legal basis for this is Art. 6 para. 1b EU GDPR (performance of contract).

The driver no longer has access to this data once the transportation has been carried out and billing has been completed.

Push notification
When using the mobility service, you can be informed about the expected arrival of the ordered passenger transportation vehicle via push notification. We can also inform you of important operational information about our transportation service via push notification.

The purpose of this data use is Art. 6 para. 1a GDPR (consent given by you).

The prerequisite for receiving push notifications is that you have activated push notifications in the settings of your mobile device. You can deactivate push notifications at any time via the settings of your mobile device.

Analysis tools
Google Firebase

We use functions of the Google Firebase analysis service for our app. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The following data is stored and analyzed:

gender
country
Device profile (model, etc.)
User behavior within the app

This information is usually transferred to a Google server in the USA and stored there.

The collected data is anonymized before an analysis is carried out. As a result, personal data is truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before being transmitted to the USA.

The purpose of collecting and using this data is to analyze our target group and improve our product functions based on usage metrics. The legal basis is Art. 6 para. 1f GDPR (our legitimate interest in analyzing user behavior in order to optimize our app) or Art. 6 para. 1a GDPR (consent given by you).

You can prevent the collection of data by Firebase by deactivating the functionality in the Permissions menu in the app. You can find more information on the handling of user data in Google’s privacy policy: https://policies.google.com/privacy?hl=de

Facebook SDK

The Facebook Software Development Kit (Facebook SDK) is used in our app. The Facebook SDK is provided by Facebook Inc, 1601 S California Ave, Palo Alto, California 94304, USA (“Facebook”). The following data is used:

App ID
the app version
the information that the app has been started.

The Facebook SDK helps us to increase the advertising success of advertising campaigns for mobile apps placed via Facebook – for example, by not displaying ads for the corresponding app on devices on which it is already installed.

The Facebook SDK also enables various evaluations of the installation of our app and the success of one of our advertising campaigns. With the help of the Facebook SDK, it is also possible for us to analyze individual activities of a user within the app, for example to define the target group for advertising campaigns more precisely and better.

Only this pseudonymized data is transmitted to Facebook. The advertising ID provided by the operating system of the end device serves as the pseudonym (the name may differ depending on the operating system). The app ID can be recreated by the user when the app is reinstalled.

The purpose of collecting and using this data is to analyze our target group and to optimize the advertising campaigns and product information. The legal basis is Art. 6 para. 1f GDPR (our legitimate interest in analysing user behaviour in order to carry out individualized advertising campaigns) or Art. 6 para. 1a GDPR (consent given by you).

Scientific purposes

The district of Wunsiedel i. F. reserves the right to use anonymized data for scientific purposes or to pass it on to scientific institutions for this purpose. The use of data for scientific purposes is regulated in Art. 89 GDPR.

c) Booking by telephone

Location-related data
The following personal data is collected when a booking is made by telephone

If the booking assistant requests a vehicle for passenger transportation via the telephone booking system, the driver (transport company Mietauto Licha) and the dispatcher of the vehicle as well as other relevant employees are provided with the following data or a part thereof:

First name (last name is optional)
the start and destination address
the number of persons whose transportation you require and
the total price of passenger transportation for the specified route.

The driver no longer has access to this data once the transportation has been carried out and billing has been completed.

Will the data and information about me be shared with others?

Your personal data will not be passed on, sold or otherwise transferred to third parties, except in the cases described in paragraph 3 above, unless this is necessary for the purpose of performing the contract or you have expressly consented to this.

If the transfer of personal data to an external service provider is necessary for the provision of a service or the response to an inquiry, we take technical and organizational measures to ensure that the legal provisions of data protection within the meaning of Art. 28 EU GDPR are complied with and also oblige the external service providers to comply with the relevant legal data protection regulations, to treat the personal data confidentially and to delete it immediately as soon as it is no longer required.

How long will my data be stored?

Your data will generally be deleted after the purpose for which it was stored has been fulfilled, unless statutory retention periods prevent deletion. These result in part from the German Civil Code (BGB), the German Commercial Code (HGB) or the German Tax Code (AO) and can normally be 6 – 10 years, in exceptional cases longer. After the expiry of such a retention period, the data will be permanently deleted.

The storage period of cookies varies according to the type of cookie and depends on your browser settings.

After the transportation has been carried out and billing has been completed, the driver (transport company Mietauto Licha) no longer has access to the data that was shared with him.

Is data also transferred to recipients outside the European Union or outside the European Economic Area (EEA)?

We pass on personal data to processors based in non-EEA countries. In this case, we ensure before the transfer that the recipient has either an adequate level of data protection (e.g. due to an adequacy decision by the EU Commission for the respective country, due to self-certification of the recipient for the EU-US Privacy Shield or through the agreement of so-called EU standard contractual clauses of the European Union with the recipient) or that sufficient consent has been obtained.

You can obtain an overview of the recipients in third countries and a copy of the specifically agreed regulations to ensure an adequate level of data protection from us. Please use the information in the Contact section for this purpose.

What rights do I have?

In accordance with the General Data Protection Regulation, you have the right to access, rectification, portability and erasure of your data.

If the data processing is justified by our legitimate interests, you have the right to object to the data processing for the future, unless the data is absolutely necessary for the operation of the app.

Your right to lodge a complaint with a supervisory authority: Without prejudice to the rights set out above, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.

The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Art. 78 GDPR.
